IN NEW MEXICO, IT’S A FOURTH DEGREE FELONY. NORMALLY, IT CARRIES AN 18 MONTH SENTENCE IN A STATE PRISON, A FINE OF $5,000. IN THIS CASE, THE D.A. HAS INDICATED THAT SHE WOULD BE ADDING WHAT’S CALLED A FIREARM ENHANCEMENT, WHICH IS A FIVE YEAR ADD ON TO THAT, ANY PENALTY TO ANY JAIL SENTENCE POTENTIALLY, BECAUSE THERE’S THE USE OF A GUN. WE ALSO ASKED JOHN IF HE WAS SURPRISED BY THESE CHARGES. FROM ONE PERSPECTIVE, IT’S A LITTLE SURPRISING. I THINK THERE WAS A LOT OF SENTIMENT THAT BALDWIN WASN’T GOING TO GET CHARGED BECAUSE ALL HE DID WAS POINT A GUN THAT WAS HANDED TO HIM. BUT I THINK WHEN WE PICK THIS APART, WE LOOK AT THE WE LOOK AT THE D.A. SAYING, LOOK, GUNS ARE SERIOUS. GUNS ARE NOT TOYS. NEW MEXICO’S A STATE WITH A LOT OF GUNS. IF YOU’RE GOING TO BE USING GUNS, WHETHER IT’S A MOVIE SET, WHETHER IT’S ANYWHERE ELSE, YOU’VE GOT TO BE TAKING IT DEADLY SERIOUSLY. IT WAS A WELL INVESTIGATED CASE, BUT WE HAD SOME FOLLOW UP THAT WE HAD TO DO, HAD TO SPEAK WITH SOME EXPERTS. AND ONCE WE READ THROUGH EVERYTHING AND RESEARCHED THE CASE LAW AND THE LAW HERE IN NEW MEXICO, WE REALIZED THAT WE BELIEVED THAT THERE WAS PROBABLE CAUSE TO CHARGE ALEC BALDWIN AND HANNAH GUTIERREZ READE WITH INVOLUNTARY MANSLAUGHTER. BALDWIN HAD MAINTAINED HIS INNOCENCE THROUGHOUT THIS, EVEN PUBLICLY SHARING THAT HIS HE HAD CONFIDENCE HE WOULDN’T BE CHARGED JUST MINUTES AGO, THOUGH, HIS ATTORNEY ADDRESSED THE CHARGES IN THIS STATEMENT HERE, SAYING THIS DECISION DISTORTS ALINA HUTCHINSON’S TRAGIC DEATH AND REPRESENTS A TERRIBLE MISCARRIAGE OF JUSTICE. MR. BALDWIN HAD NO REASON TO BELIEVE THERE WAS A LIVE BULLET IN THE GUN OR ANYWHERE ON THE MOVIE SET. I ALSO WANT TO POINT OUT THE ASSISTANT DIRECTOR FROM THE LAST MOVIE HAS SIGNED A PLEA AGREEMENT FOR THE CHARGE OF NEGLIGENT USE OF A DEADLY WEAPON. DAVID HALL WILL NOT SERVE ANY TIME BEHIND BARS, BUT WILL HAVE SIX MONTHS PROBATION. JOHN DAY BELIEVES PROSECUTORS MAY USE HIM IN THE CASES AGAINST BALDWIN AND GUTIERREZ, REED AND THE FAMILY OF HELENA HUTCHINS SENT US A STATEMENT IN REGARDS TO TODAY’S DECISION AS WELL, SAYING IN PART THIS, WE WANT TO THANK THE SANTA FE SHERIFF AND THE DISTRICT ATTORNEY FOR CONCLUDING THEIR THOROUGH INVESTIGATION AND DETERMINING THAT CHARGES FOR INVOLVE BATTERY MANSLAUGHTER ARE WARRANTED FOR THE KILLING OF HOLLY HUTCHENS WITH CONSCIOUS REGARD, DISREGARD FOR HUMAN LIFE. Alec Baldwin pleads not guilty, waives court hearing in film set shooting charges

In documents filed Thursday, Alec Baldwin pleaded not guilty to involuntary manslaughter charges and waived his first court appearance in relation to charges filed in the “Rust” film set shooting. Baldwin and a film armorer were charged last month with felony involuntary manslaughter for the fatal shooting of Halyna Hutchins, the film’s cinematographer, during rehearsals on the set in Santa Fe, New Mexico, in October 2021.In approving the waiver, First Judicial District Judge Mary Marlowe Sommer of New Mexico set conditions of release for Baldwin. Those conditions of release are as follows: Obey all federal state, tribal and local laws, statutes and ordinancesNot possess firearms or dangerous weapons, which includes any device that is capable of expelling a projectile by action of an explosionNot consume alcoholMaintain contact with defendant’s attorney/see and consult with an attorney The judge has also allowed Baldwin to have contact with other witnesses with certain conditions as plans to finish the movie proceed. The judge ordered Baldwin released on his own recognizance and did not order any bail to be posted.
